MilitaryPlanet Terms of Use & Conditions

MilitaryPlanet is a social networking service that allows users to create individual online profiles in order to contact old and new military friends. MilitaryPlanet ("MilitaryPlanet" or "we") provides services to members including unique profile pages, groups, forums, and blogs (collectively, ?MilitaryPlanet Services?). By using the MilitaryPlanet services, you (?Member?) agree to be bound by these Terms of Use & Conditions (?Agreement?) by clicking the box before completion of registration. MilitaryPlanet reserves the right to modify these Terms of Use & Conditions and such changes will be indicated in the date above. Please review these changes regularly as you will be bound to them as part of the new Agreement. MilitaryPlanet reserves the right to reject or remove any posting by you, or to restrict, suspend, or terminate your membership at any time, for any reason without warning or liability.
Eligibility
MilitaryPlanet is open to all current and prior United States military personnel. By using the MilitaryPlanet Services, you represent and warrant that all information provided in your registration is truthful and accurate. Membership in MilitaryPlanet Services is void where prohibited.
Content
You are solely responsible for all material published or displayed (?posted?) through your personal account, including images, messages (public and private), emails, forum posts, blog posts, and other interactions with other Members (collectively, ?Content?). You understand and agree that MilitaryPlanet may review and delete any Member Content. You may remove or edit your Content from the site at any time. By posting Content through the MilitaryPlanet Services, you grant to MilitaryPlanet a limited license to use, copy, perform, modify, publicly display, reproduce, translate, excerpt (in whole or part) and distribute such Content. You represent and warrant through this Agreement that you own or otherwise have the right to grant the license for the Content posted by you, and that the posting of your Content through the MilitaryPlanet Services does not violate the privacy rights, copyrights, contract rights or any other rights of any person.
You understand that the MilitaryPlanet Services are intended only for personal use of Members and may not be used for any commercial endeavors except those endorsed or approved by MilitaryPlanet. You agree not to collect email addresses or other information from Members for the purpose of unsolicited emails or other unsolicited communications. You understand that MilitaryPlanet reserves the right to remove any unauthorized commercial Content without warning and said unauthorized commercial Content may result in membership termination without warning. You agree that you may not use the MilitaryPlanet Services in any unlawful manner or in any other manner that may damage, disable, overburden or impair MilitaryPlanet.
Disclaimers
MilitaryPlanet is not responsible for any inaccurate or incorrect Content posted through the MilitaryPlanet Services, whether caused by MilitaryPlanet Members or by any of the equipment or programming associated with or utilized in the MilitaryPlanet Services. MilitaryPlanet is owned by Orion International and hosted by Synthenet in the United States. MilitaryPlanet is not responsible for the conduct, whether online or offline, of any Member or user of the MilitaryPlanet Services. MilitaryPlanet takes no responsibility for any third-party content provided by Members or advertisers. MilitaryPlanet is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or on any of the MilitaryPlanet Services or combination thereof, including any injury or damage to Users or to any personīs computer related to or resulting from participation or downloading materials in connection with the MilitaryPlanet Services. Under no circumstances shall MilitaryPlanet.com be responsible for any loss or damage, including personal injury or death, resulting from use of the MilitaryPlanet Services, from any Content posted on or through the MilitaryPlanet Services, or from the conduct of any users of the MilitaryPlanet Services, whether online or offline. The MilitaryPlanet Services are provided "AS-IS" and as available and MilitaryPlanet.com expressly disclaims any warranty of fitness for a particular purpose or non-infringement. MilitaryPlanet cannot guarantee and does not promise any specific results from use of the MilitaryPlanet Services.
Limitation on Liability
In no event shall MilitaryPlanet be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profit damages arising from your use of the services, even if MilitaryPlanet has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, MilitaryPlanet?s liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to MilitaryPlanet for the MilitaryPlanet Services during the term of membership.

Other
These Terms of Use constitute the entire agreement between you and MilitaryPlanet regarding the use of the Web site and/or the Service, superseding any prior agreements between you and MilitaryPlanet relating to your use of the Web site or the Service. The failure of MilitaryPlanet to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
